(Exclusive) Fª Alentejo: Former fire chief files lawsuit against institution.


The former commander of the Volunteer Firefighters of Ferreira do Alentejo (AHBVFA) filed a lawsuit in the Labor Court (JTB) of the Court of the District of Beja, where you want to be reimbursed for subsidies that have not been paid for several years that you have been in the position.

In action, o autor exige à AHBVFA a quantia de 7.774,04 euro, regarding the Availability and Command allowances that should have been paid during the vacation period, in conjunction with this subsidy.

The decision is based on No. 2 of article 264, do Código da Trabalho, approved by Law no. 7/2009, February 12th, which refers to the remuneration of the vacation period in addition to the salary and the vacation allowance, “the worker is entitled to other remuneration benefits that are a consideration for the specific way of performing the work, corresponding to the minimum duration of vacations”, as is the case of the Availability and Command subsidies you received monthly, with the exception of the vacation period.

António Gomes, which passed to the association's roll of honor on the day 6 December 2021, revealed to Lidador News (LN) que “depois de ter conhecimento que tinha direito a receber esses subsídios, I went to the Authority for Working Conditions (ACT) that confirmed this reality for me”, adding that he met with the direction of the firefighters that “in the face of an opinion from his lawyer, justified they would not pay me anything, hence having advanced to court”, concluded.

Turn, Vitor Roque, president of the Ferreira do Alentejo Fire Department, justificou ao LN que o assunto foi entregue ao advogado da instituição “e é ele que, objectively, understands that there is no room for reimbursement of the amounts claimed”, adding that being “the court to decide on the fairness of the lawsuit”, justified.

To be given reason to the former commander, esta pode ser uma decisão que pode fazer jurisprudência e levar muitos dos antigos e presentes operacionais da cadeia de comando dos bombeiros de Portugal Continente e Ilhas a moverem ações judiciais para receberem os subsídios de Disponibilidade e Comando.

António Gomes, passou ao quadro de Honra da AHBVFA, após quase meio século de entrega à causa dos bombeiros, 30 dos quais como comandante da corporação, tendo recebido o Crachá de Cidadania e Mérito, o Crachá de Ouro e todas as medalhas da Liga portuguesa de Bombeiros (LPB) e sido homenageado pela Câmara Municipal de Ferreira do Alentejo.

Acórdão histórico que pode fazer jurisprudência

Numa decisão datada de 25 November last year, the Court of Évora Relationship (THREE) confirmed the decision handed down by the Labor Court (JTB) of the Court of the District of Beja, que condenara uma empresa de trabalho temporário e os seus três gestores, Romanian citizenship, a pagar mais de 16 thousand euros to a worker of the same nationality.

O TRE considerou que “apesar de não ter contrato de trabalho escrito, foi demonstrado que o trabalhador prestou durante oito anos a sua atividade de forma subordinada aos réus e pelo que são todos solidariamente responsáveis pelo pagamento dos créditos”.
