A doctor at the José Joaquim Fernandes Hospital, meanwhile already renovated, was accused of negligent homicide. The victim was a fetus in apparent death (stillborn), after the mother was subjected to a caesarean section.
A judge of the Local Criminal Court of the Beja Court confirmed the order of the Public Ministry (MP) in which he accused a gynecologist / obstetrician, of 76 year old, Hospital José Joaquim Fernandes, in Beja, negligence homicide, after the defendant requested the opening of instructions.
A doctor, of 65 year old, also accused in the process and accused of the same crime, also required opening the instruction, the magistrate having decided not to pronounce it for trial, “Because there is not enough evidence of the wrongdoing in question”.
The victim was a fetus in apparent death (stillborn), after the mother was subjected to a caesarean at 07,05 hours 10 April 2015 and that according to the prosecution of the MP that Lidador Notícias (LN) We had access, had no apparent malformations, without cord or meconium circulars, nor macroscopic funicular changes, but “with a very fetid smell (hitherto undetected)".
The death of the fetus of the parturient woman was due to, according to the MP, careless performance, inattentive and inadequate ”of the accused doctor, that “increased the risk” of such occurrence, How did it happen. The prosecution maintains that, when the 04,30 hours the doctor was with the parturient woman should have determined “the immediate surgical-cesarean intervention”, and by failing to do so “increased the risk of life to the fetus, who died “due to the omissions” of the clinician.
The woman, pregnant 40 weeks and 4 days and had a premature rupture of membranes, having been admitted to the Obstetrics Emergency Service of Hospital José Joaquim Fernandes, in Beja in the late afternoon of 9 April 2015, where after being observed by the defendant she was taken to a bed in the delivery room of that hospital.
Until cesarean surgery, there were a series of situations of monitoring the parturient woman, where the non-pronounced doctor and a nurse were involved, that in the end they would prove fatal to the fetus, in the face of “careless performance, inattentive and inadequate ”of the doctor.
The accused, who is already retired as a doctor, will be judged, as material perpetrator and in the consummated form of a negligent homicide crime, resorting to a Singular Court risking a prison sentence until 5 year old.
