The Court of Évora Relationship (THREE) acquitted this Tuesday morning a Prosecutor from the Public Ministry of the Central Criminal Court of the Court of Beja, who was tried for the crimes of aggravated persecution and defamation with slanderous advertising, committed against a colleague in the same court.
In reading the judgment, the president of the TRE Collective, Judge Renato Barroso, justified that “despite the accused’s conduct being ethically reprehensibleâ€, acquitted Manuel Sota, maintaining that “one thing is the assistant’s perception, another is that the defendant’s behavior meets the requirements of the crime.â€, finished.
The judge began by stating that the vast majority of facts had been proven., including sending messages to the assistant, but, “it has not been proven that by his actions he intended to disturb or molest herâ€, adding that the messages “were not made with the aim of achieving your honorâ€, concluded.
Regarding the crime of persecution, the president of the TRE Collective, defended “the non-existence of intent with the aim of provoking fearâ€, As for the crime of defamation, said that there was “freedom of private expression, where was it made, by the assistant, a value judgment that is not in line with realityâ€, justified.
The defendant's lawyer, Carlos Pinto de Abreu, when confronted by Lidador NotÃcias (LN) if he was satisfied with the decision, justified that “I am not satisfied just with decisions. But, with truth, justice and recognition of a situation, what I have long defendedâ€, said.
To conclude, Judge Renato Barroso, maintained that: “this is a process that certainly does not end hereâ€, having the assistant's lawyer, Filipe Duarte, adding that “we will analyze the ruling and then decide whether it is possible to appealâ€, finished.
The case was revealed exclusively by LN on the day 19 April 2023, after receiving a complaint stating that “Manuel Sota, Prosecutor of the Republic of Beja harassed a colleague, also a prosecutor in the same court. In view of her refusal, there was a persecution that caused a climate of fear and insecurity, while she is teleworkingâ€, was referred to not document.
