The Panel of Judges decided not to apply the additional penalty of expulsion from the national territory “because the respective conditions were not met”, this despite the Attorney General of Ferreira do Alentejo, responsible for the prosecution, to have requested this additional penalty “if the defendant was sentenced to a concrete sentence of imprisonment equal to or greater than 3 year old, even if replaced”.
Amilton Borges, of 32 year old, was involved in a bizarre arrest, with contours to be part of a Hollywood film. In the only session of the trial, the defendant assumed the facts described in the indictment, his lawyer asked for a prison sentence of up to 5 year old, suspended in execution and expulsion did not occur, because he was taking care of the connection and was already the father of a son, arguments to which the Panel of Judges was sensitive.
