“It's been years today (Wednesday, 1 June) and must view the court's decision as an opportunity and not as a gift" said the president of the Collective of Judges. The septuagenarian had just heard that he had been declared dangerous and that the sentence of internment between 3 a 14 year old, was suspended in its execution.
What the judge and the accused were unaware of is that 24 hours earlier, the woman had filed for divorce at the Beja Family Court with a request for divorce without the consent of the other spouse.
Edward P., resident in Ferreira do Alentejo, who on Wednesday celebrated 72 year old, was charged with aggravated murder, the attempted form, perpetrated against women, of 66 year old, and possession of a prohibited weapon.
The defendant accused the victim of not wanting to have sex and not helping him to get erections and on the morning of 7 of September of last year, the defendant provided himself with a kitchen knife with a total length of 27 centimeters and 15 blade and also a rope and waited for the woman to return from shopping to kill her. Wielding the knife he shouted at him, "it's today that i kill you", at the same time I tried to hit him in the belly area. Then he went to the terrace of the house., wrapped the rope around his neck, to put an end to life, being prevented by third parties.
In reading the judgment, the magistrate told the defendant that “the easiest thing was for you to be hospitalized and the case was fixed. It is a decision that starts from a mutual trust, of the court and of himself”, justified. Suspension of sentence is subject to probation, medical treatment and prohibition of contact with the woman and of going to the family home. Edward P.. who was in pre-trial detention between 8 September and 4 December 2021, date on which the obligation to remain in the dwelling began to be fulfilled, supervised by remote technical means, saw extinct this measure of coercion, being able to walk freely through the streets of Ferreira do Alentejo.
The victim, who became an assistant to the proceedings was asking for compensation for 85.000 euros, amount that the Collective considered “excessive” and which, given the defendant’s situation, was set at 10.000 euros.
The decision of the Panel of Judges will not be appealed by the Public Prosecutor's Office, since the Public Prosecutor of Ferreira do Alentejo who prepared the accusation, as the Beja Court Prosecutor, defended the thesis that the defendant “should be declared criminally dangerous”, despite considering that he was subject to hospitalization.
