A couple of 25 year old, resident Garvão, municipality of Ourique, was sentenced, by a Collective of Judges of the Court of Beja, in a single sentence of effective imprisonment of 2 years and 6 months, for crimes of child sexual abuse and pornography of minors.
Jose Alberto, was accused of committing two crimes of sexual abuse of children and one crime of pornography of minors, both aggravated, but ended up being sentenced to partial sentences of one year and six months and nine months in prison, respectively, for each of two child sexual abuse crimes, in the form of sexual harassment and, one year in prison, for a crime of pornography of minors.
According to the ruling of the CJ of the Court of Beja, that the News had access Lidador, in August 2022, had the victim 10 year old, the defendant who lived in Garvão for around three years, “took the girl to a bathroom next to the elementary school, he felt her buttocks, dropped his pants, displayed his penis and asked the victim to touch it.”.
When in January last year, the PJ seized his smartphone, the defendant held three hundred and seventy image files “with individuals aged 14 and 16 year old, totally naked, engaging in sexual acts with other children and adults, like oral intercourse, and displaying sexual organs”, is mentioned in the ruling.
On trial, Jose Alberto, only assumed the arrest of the pornography images of minors that were taken from the cell phone, maintaining in his defense that he is “being the target of revenge because he decided to stop helping the minor’s family financially”, statements that do not deserve credibility with judges.
The defendant's defense raised the question of the possible existence of a mental disorder that could lead to non-imputability, but the tests show that “it has not been demonstrated that he suffers from any mental illness”, having sought to “discredit the testimony of the victim and a witness, you remember both, revealing that he had not internalized the guilt and blameworthiness of his actions.”, justifies the Collective of Judges.
The defendant was released pending the final judgment of the judgment, which may be appealed to the Court of Appeal of Évora (THREE), aiming to suspend the effective prison sentence imposed on the previous day 25 of September.
