The last word is from the Court of Appeal of Évora. GNR military personnel from Odemira sentenced, among other penalties, to suspension of duties, may be integrated.
A non-binding opinion from the Évora District Attorney General's Office, defends that four of the five soldiers of the Territorial Detachment of Odemira who were sentenced to accessory penalties for prohibiting the exercise of functions applied to them by a Collective Court of the Central Criminal Court of Beja (JCCB) last day 3 July.
According to a document to which Lidador Notícias (LN) We had access, the Deputy Attorney General maintains that the decision “which revoked them in the accessory penalty of prohibition on exercising their function” is revoked “due to none of the partial penalties exceeding three years”, justified.
The magistrate considers in his opinion, whose final decision belongs to the judges of the Court of Appeal of Évora, institution to which an appeal was filed, that the remaining decisions of the JCCB judges' judgment, chaired by Vítor Maneta, “Must be confirmed”, prison sentences for crimes of violation of domicile, offenses against physical integrity and kidnapping, translated into a legal cumulative and suspended in effect.
The military João Lopes, Reuben Candeias, Luís Delgado and Nelson Lima, aged between 24 and 30 year old, all from the Vila Nova de Milfontes GNR post, county of Odemira, appealed the penalties from five years to three years and six months in prison, suspended for the same periods, the payment of compensation and the prohibition on the exercise of the Guard's duties, between two and two and a half years.
Different case is that of André Ribeiro, 36 year old, the GNR military officer from Posto de Odemira, was the only one to be sentenced to an effective prison sentence, with a cumulative 6 year old, continuing to await the final sentence, under house arrest and suspended from duties for 3 years and 6 months. It was the difference in sentences that led André Ribeiro's defender to file a separate appeal to the Évora Court of Appeal.
The case originated at a dinner on the last night of September 2018, in a restaurant in Almograve, that gathered about 25 indian farm workers, "Sponsored" by Gurjit Singh, connoted by police authorities with human trafficking for labor exploitation, the five soldiers were detained in 8 May 2019, after an operation by the Setúbal PJ.
