Reformed GNR sentenced to 6 year prison. He tried to kill his ex-girlfriend's son and was convicted of the crimes of simple homicide in the attempted and aggravated threat.

A former soldier in the Republican National Guard (GNR), resident in Moura, was sentenced yesterday at the Beja Court to 6 years in prison, on a legal basis for crimes of simple homicide in the attempted and aggravated threat.

Francisco Rosa, of 61 year old, did not gladly accept that the woman with whom he had a relationship, wanted to finish the same.

The defendant who has come to court accused of manslaughter in attempted form, saw the Collective of Judges, chaired by VĂ­tor Maneta, change to simple homicide in the form attempted in the person of Vicente, woman's son, crime for which he was sentenced to 5 years and 6 months in prison and 1 year in prison for the crime of aggravated threat. He was also ordered to compensate the victim in the amount of 10 thousand euros for non-pecuniary damages and 50 euros for property damage, having to await the final decision.

Everything happened on the day 19 December 2018, after drinking alcohol, the retired GNR military, went to the woman's house, Serpa, in order to talk to that, what he didn't get after the interference of one of the children.

Not pleased that he was driven out, Francisco opened it with a knife in his pocket, hid it behind his back, stabbing Vicente, who intruded in front of the mother, hitting him in the chest, which gave him a puncture in his left lung and left him at death's door. The assaults did not reach other contours because, even after stabbing the victim, he still grabbed a stone that he threw at the accused, hitting it in the never and left the same prostrate for earth.

Before the aggression, the defendant had threatened Vicente's father, who had not lived maritally with his wife for over a year, but that arrived at the place, screaming: “You don't need to be looking at me, I will kill you, I will kill your children and I will kill your wife. I'm going to jail but I'm going to kill you all ”.

After reading the judgment, Judge Vítor Maneta found the defendant's behavior during the trial, stating that “he had every opportunity to assume his mistakes and responsibilities. Had a testimony wrong and with many lies. It makes the difference between freedom and prison ”, concluded.

After 2008, the defendant has established a de facto relationship, already finished, having then complained about the practice of the crime of domestic violence, who never came to court.
