Court of Appeal rejects appeal from Pakistani citizen convicted of attempted murder which occurred in August last year on a hill in the parish of Nossa Senhora das Neves, county Beja.
The Court of Évora Relationship (THREE) dismissed the appeal presented by the defense of a Pakistani citizen from 41 year old, who wanted to see the prison sentence reduced and suspended and the amount of compensation to be paid reduced.
Sohail Abbasi, He was convicted last day 15 of September, by a Collective of Judges (CJ) of the Court of Beja to a penalty of 5 years and 6 months, for the commission of a crime of simple homicide in the attempted form, perpetrated against a fellow countryman, also 41 year old, who attacked with the use of a bladed weapon.
In addition to the prison sentence, the defendant was ordered to pay 5.000 euros of compensation to the victim and 27.329,51 euros to Hospital de Beja as expenses for the victim.
Although the crime provides for the application of a lower penalty, that its execution be suspended, the president of the CJ who judged the case, justified that the sentence was heavier because the defendant “intended to kill the victim, having demonstrated a violent personality and showing a lack of regret.”, concluded.
The crime occurred on the night of 20 August 2022 on a hill in the parish of Nossa Senhora das Neves, county Beja, when the two Pakistanis were involved in a physical confrontation, caused by alcohol intake. Sohail Abbasi wielded a kitchen knife 15 centimeters of blade and struck the victim five times, who only did not die due to the medical-surgical intervention he was subjected to at Beja Hospital.
The defendant was subject to preventive detention since 22 August, the sentence having become final and unappealable last day 21 of December, date of decision-making by the TRE Judges.
