Reuben Candeias, of 27 year old, one of the seven soldiers of the Republican National Guard (GNR) from the territorial post of Vila Nova de Milfontes, county of Odemira, expelled from the corporation following conviction in cases of aggression against Indonesian citizens, wants to reverse the decision of the General Command of the Guard.

In an order dated 9 August, José LuÃs Carneiro, applied to Rúben Miguel da Costa Candeias, of the Emergency Protection and Relief Unit (UEPS), “the disciplinary penalty of separation from serviceâ€, which in practice means expulsion from the corporation.
After a second conviction, to an effective prison sentence 6 year old, Rúben Candeias' defense appealed to the Évora Court of Appeal (THREE) which reduced the penalty for 4 years and 8 months, suspended from its effectiveness and “revoke the part in which the defendant was sentenced to the additional penalty of prohibition from exercising military functions in the GNRâ€, whose period was 3 years and 6 months.
In view of the TRE decision, the soldier was reinstated, but following the judicial process, the General Inspectorate of Internal Administration opened a case against all GNR soldiers accused of the attacks, which has now culminated in the departure of Rúben Candeias from the institution.
And it is supported by the decision of the Évora Court that the defendant's defense filed the action with TAFBeja, aiming to annul the minister's decision supported by the proposal of the General Command of the GNR and published in the Diário da República last day 7 of September.
In addition to the sentence he was sentenced to in 10 January this year, the GNR soldier was still serving another prison sentence 4 year old, suspended on execution, of a case judged in July 2020 with the same contours.
In addition to Rúben Candeias, João Lopes and Nelson Lima, who at the time of the events also worked in the territorial post of the GNR in Vila Nova de Milfontes, and convicted in both cases, will also be subject to a new trial in the Beja Court, for the application of the legal cumulus. Lopes and Lima are the only ones of the six defendants to whom the General Command of the Guard did not impose any additional penalty., since the remaining three involved in the attacks were subject to a disciplinary penalty of 180 days of aggravated suspension.
Given the total sum of the two penalties, Reuben Candeias (8 years and 8 months) and João Lopes (8 years and 4 months), risk being sentenced to sentences of more than five years, what happening, makes them have to serve effective imprisonment. Whatever the decisions of the president of the Panel of Judges that judged the case,, which may also involve changing coercive measures, they are always subject to appeal to the Court of Appeal.
