Twenty-seven commanders and second commanders of the CDOS, exercised functions in 2020 illegally. Among them is the BOD CODIS, whose service commission ended the 25 January. Office of “designation, replacing” posted to 23 October.
Sixteen commanders, exceptions are Lisbon and Leiria, and eleven second commanders of District Operations and Relief Commands (CDOS) of the National Emergency and Civil Protection Authority (ANEPC) illegally held their positions for several months throughout the current year.
At issue is the fact that after the three-year service charges for which they had been appointed have ended, they have not been renewed, what only happened between 22 and 28 October, when dispatches of designations were published, replacing.
On those dates, were published in Diário da República, 27 dispatches signed by the president of ANEPC, Lieutenant-General Mourato Nunes, to legalize the situation of commanders and second-commanders, with retroactive effect to the dates on which they had no legal connection to the Authority.
District Commanders (CODES) and the seconds, targeted at renewals, had finished the “assignment, on service commission, for three years ”, some there 8 and others there 9 months. The most aberrant case is that of Hermenegildo Abreu, commander of the CDOS of Braga, since 1 January 2020, that the service commission had ceased, and whose renewal took place on the past day 22 October, almost ten months later.
Us 27 diplomas signed by Mourato Nunes, is “designate, in place ”for the position, the same person who used to exercise it, with the justification that “holds the aptitude, the suitability, Professional experience and competence to perform the functions inherent to the position ”, not revealing how long this appointment lasts.
Last Thursday, the Lidador News (LN) asked several questions to ANEPC to clarify the situation, but silence was the way to unravel any doubts. Two of the questions asked were aimed at knowing whether the mentioned elements are not legally appointed for the positions, where did the funds come from to pay their salaries and if the decisions made by them had legal grounds.
LN also wanted to know when the ANEPC president was thinking of applying the Decree-Law published to 1 April 2019, that created the new Organic law of the Authority, on the recruitment of Commanders and 2nd Regional and Sub-regional Commanders, that forces you to contest, but the answer was to “wait on low heat”.
It is recalled that the president of ANEPC, Mourato Nunes, is accused in the case of anti-smoking collars, a case that was reported by Jornal de Notícias to 26 July 2019, process that involves a total of 18 Defendants, accused of alleged corruption in said business.
