Termination of the contract for the construction of the Pulo do Lobo Walkway by the Chamber of Serpa, takes the company that won the tender to appeal to the court.
To Calaveiras company, Lda, based in Torres Vedras, filed with the Administrative and Tax Court (TAF) Beja, of a lawsuit which, among other things, challenges the termination of the contract by the Municipality of Serpa for the construction of the Pulo do Lobo walkway, on the left bank of the River Guadiana
In the process that was filed with the TAF last Monday, in addition to demanding payment of 275.305,50 euros for work already done, the company files other precautionary actions, aiming to block the opening of a new public tender for the conclusion of the contract that the municipality denounced.
Upon termination of the contract, the municipality advanced the hypothesis of “claiming compensation for breach of contractâ€, but it was the company that anticipated and filed the indemnification process and suspension of other actions. It was through Lidador NotÃcias (LN) that the Executive of the Chamber of Serpa became aware of the action entered in the TAF of Beja, having one elected stated “not aware of any process or court notification on the matterâ€, justified.
At the Serpense Municipal Executive's meeting held last 5 January, the decision was taken to immediately terminate the contract with the company, based on "the breach of contract", sustaining the autarchy that there was still “lack of quality of the work carried out and the permanent delays in the execution of the workâ€.
With the termination, the Municipality will trigger the holding of a new public tender for the completion of the walkway., situation that Calaveiras opposes with the entry of the process in the TAF of Beja. The initial contract was signed, between the two parties, in 7 May 2019, and the city council justified that “after more than two years, the work has not been completed, claiming that the company has repeatedly requested the extension of the deadlines for completion of the work, alleging “difficulties in the delivery of materials caused by the pandemicâ€, justified.
The Serpa Chamber project aims to build two wooden walkways, in opposite directions, with three pedestrian sections, a staircase and three living areas, to allow a safe visit to the Pulo do Lobo waterfall area, no river Guadiana, to allow a safe visit to the Pulo do Lobo waterfall area.
