Serpa: Court considers ex-employee of the municipality unimputable.


A former Serpa City Council employee (CMS), accused of 10 theft crimes, qualified, simple and in the tried form and 2 crimes of embezzlement, yesterday was considered unimputable by a Panel of Judges (CJ) the Court of Beja.

The judges gave it as proven that the individual has a picture of chronic psychosis, with exacerbation episodes due to cocaine and cannabis consumption and medication abandonment.

The individual, of 44 year old, is subject to the coercive measure of preventive hospitalization at the São João de Deus Prison Hospital, in Caxias, municipality of Oeiras, from 31 May 2022, “situation in which you will go at most during the next eight years, no minimum periodâ€, justified the president of the CJ in the reading of the judgment.

The defendant was an employee of CMS between July 2018 e agosto de 2022, performing the functions of operational assistant at the municipal shipyard, having between February and the end of May last year, when he was arrested, the individual carried out several thefts. From inside his workplace he took various amounts of diesel and other objects, causing damage of approx. 1.000 euros, in a commercial establishment, he stole a mobile phone worth 170 euros and from the interior of a residence on an agricultural property took several marial worth 600 euros.

The defendant had several psychotic episodes., even after being in the Caxias Prison, due to abstinence from narcotics and when he perpetrated the thefts, the prosecution argued that “he was unable to assess the illegality of his behaviorâ€.

In reading the judgment, the president of the Collective of Judges understood that “there is no evidence that in freedom he would not commit new crimes. The measure also aims at their safety and an opportunity for a new life., with mental stability, justified the magistrate.
