Vidigueira: Woman suffered “rear naked choke” blow, but refused to testify against the defendant.
She was assaulted in several ways, spat in the face and suffered a stroke “kill lion”, but in court did not testify against the ex-partner who raped her for more than two years.
The woman who suffered a “rear naked choke” breach by her then partner and father of her three-year-old son, yesterday appeal testify as prosecution witness, against the defendant, having also refused to accept any compensation if his attacker was convicted.
Heard by videoconference from the Setúbal Court, the woman used the faculty that the law gives her for being a direct family member of the accused, not to provide any clarification on the assaults of the victim between 6 September 2017 and 30 January 2020.
The same happened with another witness, who was also beaten by the defendant during a biker rally in Vidigueira, locality where the accused lived with the victim, who ended up dropping the complaint and clarified little about the aggressions he saw the individual making on his partner.
But the defendant, of 25 year old, resident in Vidigueira and in preventive detention at Beja Prison, also did not act otherwise, having referred to the silence before the Collective of Judges of the Court of Beja, where he started to be tried for the crimes of domestic violence and qualified homicide in the attempted form, perpetrated with his partner and mother of a child of the couple and a crime of aggravated threat, in the finished form, against an amide like this.
Na dawn 30 January this year, when he was detained by the GNR, the individual was dismayed by the fact that his partner was in a bar, he addressed her and applied a blow known as a “rear naked choke”, having the intervention of a client prevented the woman from being killed.
