An individual residing in Vidigueira, was sentenced on Friday to a sentence of 7 years of imprisonment in legal accumulation, for sexual abuse of his daughter, of 8 year old, and domestic violence against her and a brother of the same age.
As compensation, the parent will have to pay 5.000 euros to his daughter and 2.500 euros to the son.
The defendant was also sentenced to four additional sentences: 10 years without being able to be linked to any situation involving minors, inhibition of responsibilities for children or dependent children due to 15 years and ban on contact with children for five years. Must attend domestic violence programs.
For three crimes of aggravated child sexual abuse, the defendant was sentenced to three different prison terms, between 1 year and 6 months and 4 years and 9 months and for the two crimes of aggravated domestic violence, in 2 years and 6 months in prison each. In total, the defendant was sentenced to 15 years and 9 months in prison, reduced to seven years due to legal cumulation.
To scare the daughter, the parent told him: "Keep secret, Don’t tell anyone or you’ll get beaten up.”, situation happened just like it happened with the son, to avoid publicizing situations of abuse.
Despite the individual having denied committing the crimes, the court found that the defendant abused his daughter during the months of September and October 2022, particularly on weekends, maintaining the president of the Collective of Judges that the penalty is based on the “defensive and strange way in which he lightened responsibilities, going so far as to claim that it was his daughter who asked him.”, the magistrate used the popular refrain of “bad payer excuses”, to report the defendant's behavior.
“His apology involved accusing his sister of wanting to harm him, when she was called to make a statement, didn’t do it”, reminded the judge, who considered the testimony of the two children about the acts committed by their parent to be very credible.
Until final judgment of conviction, the defendant will await freedom, subject to term of identity and residence (TIR), weekly presentations by the GNR of Vidigueira and prohibition of contact by any means and of approaching children less than 200 meters.
